A planning permit is a legal document issued under the Planning and Environment Act 1987 that gives permission for a use or development on a particular piece of land.
Planning permits are issued by council if they agree with a proposal and they will contain a list of conditions that need to be satisfied.
An endorsed plan will usually form part of the permit.
What the permits allows for will be stated on the front page of a permit.
.All permits are subject to a time limit and will have an expiry date. In some circumstances a request may be able to be made to have this date extended.
Planning Permit Conditions
Generally the conditions stipulated on a planning permit will be required to be satisfied prior to either Certification or Statement of Compliance.
Other conditions may be general requirements under the Subdivision Act or Planning & Environment Act
VicSmart Applications
VicSmart is a streamlined assessment process for straightforward planning permit applications. Classes of application are identified in the planning scheme as being VicSmart and have specified requirements for information, assessment processes and decision guidelines.
Key features of VicSmart include:
- a 10 day permit process
- applications are not advertised
- information to be submitted with an application and what council can consider is pre-set
- the Chief Executive Officer of the council or delegate decides the application
